OPTA FIVE CONTEST
OFFICIAL GAME OF SKILL RULES

"Opta Five" (the "Contest") is sponsored by Perform Content Limited, company number 11562035, with a registered address of The Point, 37 North Wharf Road, Paddington, W2 1AF, England ("Stats Perform") and is administered by 20Shots Limited, company number 11717480, with a registered address of Palladium House, 1-4 Argyll Street, London, United Kingdom, W1F 7LD ("Administrator").


For the purposes of the Contest and these Official Rules,Stats Performshall include Stats Perform's affiliates, members of its group and any related companies.


The Contest is free of charge to enter and no purchase or payment of any kind is necessary to enter, win or claim a prize. A purchase or payment will not increase your chances of winning. Your participation in the Contest constitutes your full and unconditional agreement of these Official Rules and your agreement to be bound by them. The Contest is a game of skill.


  • 1. ELIGIBILITY

    To be eligible to participate, you must: (a) be at least 18 years of age or (if different) the age of majority or older in your jurisdiction of primary residence as of the date of participation; (b) possess a valid form of identification, which Stats Perform may require Entrants to provide in order to show proof of age and identity; (c) be capable of accessing the Internet; and (d) have completed Registration and have an open, valid My Opta account (each, an "Entrant").


    Notwithstanding the foregoing, however, the following persons are not eligible to participate and are prohibited from participating in the Contest: (i) persons that are subject to U.S., EU, or UK property-blocking or asset-freezing sanctions; (ii) persons that are ordinarily resident in any jurisdiction subject to comprehensive U.S., EU, or UK sanctions; (iii) residents and entrants from Italy or any territory bound by Italian law; (iv) residents or entrants from South Korea or any territory bound by South Korean law; (v) residents or entrants from Nigeria or any territory bound by Nigerian law; (vi) persons resident or located in the States of Telangana and Andhra Pradesh in India; (vii) persons where the Contest is in any way prohibited by any law, regulation or other restriction; and (viiii) all officers, directors, employees and agents of Stats Perform, including any members of any immediate families (being parents, siblings, children and spouses, regardless of where they live) or households (whether or not related) of such persons (collectively (and including (a)-(d) in the paragraph above), the "Eligibility Criteria"). The Contest will be void where otherwise prohibited or restricted by law. Participation constitutes Entrant's full and unconditional agreement to these Official Rules and Stats Perform's decisions, which are final and binding in all matters related to the Contest. All eligibility determinations to be made at Stats Perform's sole but reasonable discretion.


  • 2. CONTEST PERIOD

    The Contest Period will be from the kickoff of the first fixture in the Game Schedule on October 21, 2023 and end on the kickoff of the last fixture in the Game Schedule, which is currently scheduled for May 19, 2024. The Game Schedule can be found here – https://optamax.soccerway.com/fixture. The Game Schedule may be updated in line with updates made to the Premier League and/or WSL fixture lists, which are beyond the control of Stats Perform.


    The Contest consists of thirty-two (32) game weeks (each, aGame Week, and collectively, theGame Schedule). Most Game Weeks will run from Saturday to Friday; however, Game Weeks are subject to change based on updates made to the Premier League and/or WSL fixture lists, which are beyond the control of Stats Perform. The Game Week timetable will be found on the Game Schedule and will be updated as soon as reasonably practicable, and in any case no later than five calendar days after the schedule change.


  • 3. HOW TO ENTER

    During the Contest Period, an eligible Entrant (see Section 1 above for the Eligibility Criteria) may enter by visiting https://optafive.soccerway.com , then either Sign In with an existing My Opta account or, if the Entrant does not yet have a My Opta account, register (Registration) for a My Opta account by clickingSign Up and following the instructions to complete and submit the Registration form by providing the required information as instructed. It is free of charge to register for a My Opta account. Complete Registration is required for valid entry in this Contest.


    Entrants may enter any of the Opta Five Game Weeks. To enter, Entrants must submit their five (5) Opta Five predictions for the Game Week. Entrants are not required to enter the Opta Five contest every Game Week. By creating a My Opta account, Entrants are able to enter any Opta Five or Opta Max Game Week, but not required to do so. Entrants are not required to make any purchase or payment of any kind in order to enter or win a prize.


    If you meet the Eligibility Criteria, you may enter the Contest during the Contest Period prior to the Entry Deadline by completing and submitting the information requested at https://optafive.soccerway.com and by following the on-screen instructions.


    By submitting an entry for the Contest, you confirm that you have read, understand and agree to abide by these Official Rules.


    Each entry must adhere to the Eligibility Criteria set out in Section 1 above and in all other respects comply with these Official Rules, otherwise such entry will be void and ineligible for entry into the Contest.


    All entries must be received by the Entry Deadline, which for most Game Weeks is 15:00 BST/GMT on each Saturday of that Game Week. For fixtures that kick off before 15:00 BST/GMT on a Saturday of a Game Week, predictions for these fixtures must be submitted on a per fixture basis, at any time prior to the kick off of each such fixture. Further information regarding the applicable Entry Deadline for each fixture can be found on the Game Schedule at https://optamax.soccerway.com/fixture.


    Entries must be made using only the My Opta account subscribed to, and registered in, your name. Entries must be submitted by you and not any third party. Each Entrant can only make one entry to each Opta Five Game Week.


    In the event of a dispute regarding entries submitted by multiple individuals using the same e- mail account, the only eligible entry will be the entry submitted by the authorized subscriber to the e-mail account used to enter the Contest at the actual time of entry. The authorized e-mail account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Any such dispute will be resolved by Stats Perform in its sole but reasonable discretion.



  • 4. THE CONTEST

    During the Contest Period, Entrants will be required to predict one (1) player from each of five (5) Premier League fixtures, or five (5) Women's Super League (WSL) fixtures, in a single Game Week, that will be awarded a higher Opta Player Rating than the predicted Opta Player Rating that player is displaying in the Contest (the Predicted Opta Player Rating). Entrants can select from any player in a team's squad. The Opta Player Rating for each player is awarded after the fixture is completed.


    Note: Standard message and data charges may be incurred by using a mobile device to participate in any aspect of the Contest. Check with your wireless service provider for details or any applicable charges. Entrants are solely responsible for any such wireless charges.


  • 5. OPTA PLAYER RATINGS

    Opta Player Ratings are a score or mark out of 100 that indicates how well a football player has played in a particular fixture. The higher the score, the better the player played. Opta Player Ratings range from 20 to 100, with 60 being the rating for anaverage performance.


    Opta Player Ratings are designed to score a football player's performance using six (6) subcomponents, and specific metrics within each subcomponent, as follows:


    • Shooting: This subcomponent prizes efficiency. Shot location and type is taken into account by proxy (e.g. outside/inside the box as opposed to exact x,y location), and players are given credit for the outcomes of their shots relative to the difficulty as measured by these proxies. Though a player shooting many times will positively affect their attacking subcomponent score, if these shots are constantly missing the target, they may have an unflattering shooting subcomponent score. The metrics for this subcomponent are goals and saved, blocked and missed shot counts for:
      • penalty kicks;
      • free-kicks;
      • headers;
      • inside the box shots; and
      • outside the box shots.
    • Passing: This subcomponent assesses a player's efficiency in circulating the ball within their team while in possession. Location is split here by sections of the pitch and goalkeepers are credited for the accuracy of their throws. The metrics for this subcomponent are successful and unsuccessful counts of:
      • passes in final, middle and defensive third of the pitch;
      • crosses for set pieces and open play; and
      • keeper throws.
    • Possession: This subcomponent attempts to measure a player's effect on their team's ability to retain and solidify possession. The metrics for this subcomponent are:
      • foul counts for and against;
      • aerials and take-ons won and lost;
      • dispossession count;
      • possession gained counts in final, middle and defensive thirds of the pitch; and
      • total offside and yellow and red cards.
    • Defending: his subcomponent incorporates two (2) elements: (i) an active defensive element, which uses stats on defensive actions directly accumulated by the player such as tackles, interceptions, errors and own goals; and (ii) a passive defensive element, which considers the attacking output of the other team as a whole relative to how much that team possessed the ball in the player's defensive third, and apportions credit to a player for their role in preventing or allowing this attacking output. The metrics for this subcomponent are counts of:
      • own goals;
      • oerrors leading to shots;
      • oerrors leading to goals;
      • otackles;
      • ochallenges lost;
      • ointerceptions;
      • oclearances;
      • opasses, shots and crosses blocked; and
      • openalties conceded.
    • Attacking: This subcomponent attempts to quantify how much a player is contributing to their team's offensive output. Here, volume is more important than efficiency. More contributions to attacking statistics such as assists, shots and crosses from open play affect this subcomponent. The metrics for this subcomponent are totals for:
      • fastbreaks;
      • fouled in final third of the pitch;
      • dribbles;
      • goal assists;
      • shot assists;
      • big chances created;
      • shots inside the box;
      • shots outside the box;
      • in play crosses; and
      • through balls.
    • Goalkeeping: This is the main (though not complete) subcomponent for evaluating a goalkeeper's performance. The metrics for this subcomponent are totals for:
      • in play shots saved inside the box;
      • in play goals conceded inside the box;
      • in play shots saved outside the box;
      • in play goals conceded outside the box;
      • penalties saved;
      • penalties conceded;
      • crosses claimed;
      • crosses not claimed;
      • successful keeper sweeps; and
      • unsuccessful keeper sweeps,

    (each of the above, a Subcomponent).


    Each Subcomponent metric has a corresponding coefficient that is used to weight the importance of that metric to the overall Subcomponent score. These metrics are further weighted by player position (see below), ensuring scores are distributed fairly across each of the Subcomponents, regardless of the football player's position.


    Each Subcomponent score is weighted to give a rating depending on the player's position as follows:

    • Goalkeeper: Shooting – 0%; Passing – 5%; Possession – 10%; Defending – 5%; Attacking – 0%; and Goalkeeping – 80%
    • Central Defender: Shooting – 10%; Passing – 15%; Possession – 20%; Defending – 45%; Attacking – 10%; and Goalkeeping – 0%
    • Defender*: Shooting – 10%; Passing – 15%; Possession – 20%; Defending – 45%; Attacking – 10%; and Goalkeeping – 0%
    • Wide Defender (i.e., Fullback or Wingback):Shooting – 10%; Passing – 15%; Possession – 20%; Defending – 40%; Attacking – 15%; and Goalkeeping – 0%
    • Defensive Midfielder: Shooting – 15%; Passing – 30%; Possession – 20%; Defending – 20%; Attacking – 15%; and Goalkeeping – 0%
    • Central Midfielder: Shooting – 15%; Passing – 30%; Possession – 20%; Defending – 15%; Attacking – 20%; and Goalkeeping – 0%
    • Midfielder*: Shooting – 20%; Passing – 25%; Possession – 20%; Defending – 15%; Attacking – 20%; and Goalkeeping – 0%
    • Wide Midfielder: Shooting – 20%; Passing – 20%; Possession –20%; Defending – 10%; Attacking – 30%; and Goalkeeping – 0%
    • Attacking Midfielder: Shooting – 20%; Passing – 25%; Possession – 20%; Defending – 10%; Attacking – 25%; and Goalkeeping – 0%
    • Wide Forward: Shooting – 40%; Passing – 15%; Possession – 10%; Defending – 5%; Attacking – 30%; and Goalkeeping – 0%
    • Forward*: Shooting – 40%; Passing – 10%; Possession – 15%; Defending – 5%; Attacking – 30%; and Goalkeeping – 0%
    • Center Forward: Shooting – 45%; Passing – 10%; Possession – 10%; Defending – 5%; Attacking – 30%; and Goalkeeping – 0%

    (together, the Weighting)


    The above positions are identified based on a player's starting position within the listed formation of a given fixture, except for the starred positions (those marked with *), which are present when a detailed position is unavailable for a given player, which is usually when a player makes an appearance as a substitute.


    As set out above, for each fixture, each player can receive a maximum score of 100 which is distributed between six (6) Subcomponents and given the relevant Weighting. By way of example, a central defender can receive up to a maximum score of:

    • 10 for shooting (10% of 100);
    • 15 for passing (15% of 100);
    • 20 for possession (20% of 100);
    • 45 for defending (45% of 100);
    • 10 for attacking (10% of 100); and
    • 0 for goalkeeping (0% of 100),

    Stats Perform will assess each player based on the Subcomponents relevant to them, after each fixture, and award each player a score out of 100 based on the Weighting given to each Subcomponent for each individual player. This score is the Opta Player Rating.


  • 6. LEADERBOARD & SCORING

    Opta Five is one (1) of two (2) contests that contribute to leaderboards (with the other contest being Opta Max). Each contest has its own leaderboard, but any Entrant with a score from either contest will appear on the combined leaderboard for both contests (theCombined Leaderboard).


    The Combined Leaderboard consists of five (5) divisions, with division one (1) being the highest and division five (5) being the lowest. All Entrants will begin the Contest in division five (5). Entrants in division five (5) to division two (2) will be assorted into separate 100 Entrant leaderboards, and division one (1) will include all Entrants who have been promoted from division two (2). Entrants will be promoted or relegated between divisions by being in the top or bottom 25% of Entrants, respectively, within their respective leaderboard. There is no relegation from division five (5) or promotion from division one (1) of the Combined Leaderboard. Promotion and relegation will take place after every seven (7) Game Weeks.


    Entrants receive a score from Opta Five based on their predictions. The score for incorrectly predicting a player to exceed their Predicted Opta Player Rating is equal to the predicted player's Opta Player Rating for that fixture. For example, if an Entrant predicts a player to exceed a Predicted Opta Player Rating of 41, but the predicted player only achieved an Opta Plyer Rating of 40 for the fixture, the Entrant will earn 40 points. The score for correctly predicting a player to exceed their Predicted Opta Player Rating is double the predicted player's Opta Player Rating for that fixture. For example, if an Entrant predicts a player to exceed a Predicted Opta Player Rating of 94, and the predicted player achieves an Opta Player Rating of 95 for the fixture, the Entrant will earn 190 points.     During the last two (2) Game Weeks of the Contest, all scores from Opta Five will be worth double the amounts described above.


  • 7. PLAYER CARDS & STICKERBOOKS

    If you select a player that achieves an Opta Player Rating above their Predicted Opta Player Rating, you will be awarded a digital player card (Digital Player Card). You can only earn one (1) version of a Digital Player Card from either Opta Five or Opta Max; however, you can earn multiple Digital Player Cards from the same team and store them in your user profile. If you earn an Opta Five Digital Player Card, you cannot earn an Opta Max Digital Player Card for the same player.


  • 8. THE PRIZE

    The prize for correctly identifying a player awarded a higher Opta Player Rating than their Predicted Opta Player Rating in all five (5) fixtures of a Game Week will be $500 US. If two (2) or more Entrants correctly predict a player to exceed their Predicted Opta Player Rating in all five (5) fixtures of a Game Week, the prize pot will be shared equally between all potential winners. If there are no winners for a particular Game Week, the $500 US prize will be carried over to the next Game Week, and so on for each of the remaining Game Weeks.


    Whichever Entrant holds position number one (1) in division one (1) of the Combined Leaderboard at the end of the Contest Period will be awarded a prize of $10,000 US, position two (2) in division one (1) will be awarded $1,000 US, position three (3) in division one (1) will be awarded $500 US, position four (4) in division one (1) will be awarded $300 US and position five (5) in division one (1) will be awarded $200 US. In the event two (2) or more Entrants have the same whole number score, the score will encompass the first decimal point and, in the event two (2) or more Entrants have the same whole number and first decimal point score, the score will encompass the second decimal point, and so on considering additional decimal points until the tie is broken.


    There will be two (2) prizes associated with collection of Opta Five and Opta Max Digital Player Cards:

    • A prize for collecting Digital Player Cards across the widest range of clubs in the Premier League & WSL by the end of the Contest Period: $5,000 US.
      • Where the number of clubs represented across the collected Digital Player Cards is tied, the prize will go to the Entrant with the most Digital Player Cards during the Contest Period.
        • If the number of Digital Player Cards is also tied, the prize will go to the Entrant with the highest cumulative score for all their Digital Player Cards. In the event two (2) or more Entrants have the same whole number cumulative score, the cumulative score will encompass the first decimal point and, in the event two (2) or more Entrants have the same whole number and first decimal point cumulative score, the cumulative score will encompass the second decimal point, and so on considering additional decimal points until the tie is broken.
    • A prize for collecting Digital Player Cards representing all eleven (11) positions in a formation first: $5,000 US.
      • Where the number of Game Weeks to populate a formation is tied, the prize will go to the Entrant with the highest number of clubs represented by the players in their formation.
        • If that is tied, then the prize will go to the Entrant with the highest cumulative score of the Digital Player Cards in their formation. In the event two (2) or more Entrants have the same whole number cumulative score, the cumulative score will encompass the first decimal point and, in the event two (2) or more Entrants have the same whole number and first decimal point cumulative score, the cumulative score will encompass the second decimal point, and so on considering additional decimal points until the tie is broken.

  • 9. WINNER VERIFICATION, NOTIFICATION AND PRIZE CLAIM CONDITIONS.

    1. All potential prize winners in accordance with Section 8 (each aPotential Winner) are subject to verification of eligibility (including the Eligibility Criteria) and compliance with these Official Rules. All prize winners will be determined at Stats Perform's sole but reasonable discretion.
    2. Potential Winners will be notified by Stats Perform via the e-mail address provided by the Potential Winners at time of entry. The return of any Potential Winner notification as undeliverable, the inability to reach the Potential Winner or failure of the Potential Winner to respond to Stats Perform's notification in accordance with this Section, failure to provide proof of eligibility (if requested), Release documents, Tax Documentation (if required) or other required documentation in a timely manner, or other non-compliance with these Official Rules may result in disqualification and forfeiture of the prize (at Stats Perform's sole but reasonable discretion). In the event of disqualification, Stats Perform may select a substitute Potential Winner based on the prize criteria.
    3. All Potential Winners must complete and return to Stats Perform (or its authorized agent), if requested, a written confirmation of their eligibility and compliance (and for U.S. Contestants only, his/her Social Security Number if required for tax reporting purposes) and a liability and publicity release (collectively, theRelease), releasing Stats Perform and Administrator from any liability in connection with this Contest, within seven (7) days of receipt of the notification described in subsection (b) above, or the prize may be deemed void (at Stats Perform's sole but reasonable discretion).
    4. All prize winners shall be solely responsible for all taxes related to winning.
    5. There are no prize alternatives.
    6. Once a Potential Winner has responded to Stats Perform and verified their details they will receive their prize within thirty (30) days.
    7. Winner's names will also appear on https://optamax.soccerway.com/leaderboards?gameId=opta5 , the day after each Game Week is completed, as applicable.

    If you are based in the U.S. or have any U.S. tax obligations, and have won more than $600 US or more worth of prizes from Stats Perform in a calendar year, you will receive an IRS form 1099 from Stats Perform after the end of the calendar year in which the prizes were awarded, and a copy of such form will be filed with the Internal Revenue Service (IRS), or such other tax form as may be required by the laws of the jurisdiction in which the winner resides. Each prize winner shall complete all tax documentation required by the law of the jurisdiction in which the prize winner resides (Tax Documentation).


  • 10. PRIZE WINNER INFORMATION

    The name of the prize winners may be obtained by sending an email to: marketing@statsperform.com.


  • 11. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS

    All Contest entries and any accompanying material submitted to Stats Perform may be used by Stats Perform as detailed in these Official Rules and will not be returned.


    By submitting an entry to the Contest and any accompanying material, Entrants agree that their entry (or excerpts from their entry), their name and (if submitted by them) their likeness may be published in connection with their results in the Contest (such as in online leaderboards or other reports of Entrant results), subject to the provisions of Section 16 of these Official Rules below.


  • 12. GENERAL CONDITIONS OF ENTRY

    1. Stats Perform will not replace any lost or stolen prizes.
    2. Any attempt to exceed the maximum number of entries per person is a violation of these Official Rules and may result in disqualification. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.
    3. Entrants assume all risk of lost, late, misdirected, incomplete, or illegible entries. Incomplete, corrupted, garbled, misdirected or otherwise illegible entries, or entries without contact information, or which do not conform to the requirements of these Official Rules, are void and will not be accepted.
    4. Stats Perform reserves the right to disqualify fraudulent entries or entries suspected of being fraudulent, as determined by Stats Perform in its sole but reasonable discretion. All entries submitted become the sole property of Stats Perform and will not be acknowledged or returned.
    5. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and/or civil law, and should such an attempt be made, Stats Perform reserves the right to seek damages from any such person to the fullest extent permitted by law.
    6. If Stats Perform discovers or has any reason to believe that there has been a breach by you of these Official Rules, including (without limitation) if your entry does not meet the Eligibility Criteria and/or in any other respect does not comply with these Official Rules, Stats Perform will be entitled to exclude you from participating in the Contest and your entry (including any potential prize) will be void or disqualified (as applicable).

  • 13. LIMITATION OF LIABILITY AND RELEASES

    These Official Rules do not limit or exclude (or seek to limit or exclude) Stats Perform's or Administrator's liability for death or personal injury caused by their negligence or that of their employees or agents; for fraudulent misrepresentation by Stats Perform or Administrator or their employees or agents; for Stats Perform's or Administrator's breach of your statutory rights as a consumer in relation to the Contest; or for any other liability which it would be unlawful to restrict or exclude.


    By participating in this Contest and subject always to the paragraph above, you agree that each of Stats Perform and Administrator have no liability whatsoever for (and you shall hold harmless and release Stats Perform, Administrator, and their respective group, officers, directors, agents, employees, and all others associated with the development and execution of this Contest from and against) any claims, losses, damages, costs or expenses of any kind arising from or in connection with:

    1. entry or participation in this Contest, including access to and use of the Contest website;
    2. exercise by us of any of our rights under these Official Rules;
    3. your breach of these Official Rules;
    4. any claims based on personality or privacy rights, defamation or prize delivery;
    5. the acceptance, possession, use, or misuse of a prize, including but not limited to liability for, damage to property, and damage or loss of any other kind;
    6. any incomplete or inaccurate information that is caused by your use of Stats Perform websites, or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of submissions in the Contest;
    7. lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections;
    8. the theft, destruction, loss or unauthorized access to, or alteration of, entries;
    9. any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs;
    10. garbled transmissions or miscommunications;
    11. failure of any e-mail to be received by or from Stats Perform or Administrator for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility;
    12. damage to your data or computer equipment (software or hardware) occasioned by participation in or downloading of materials related to this Contest (unless such damage arises as a result of Stats Perform or Administrator's failure to exercise reasonable care and skill);
    13. printing, distribution, programming or production errors, and any other errors or
    14. malfunctions of any kind, whether human, mechanical, electronic or otherwise in connection with the Contest; or
    15. technical, pictorial, typographical or editorial errors or omissions in connection with the Contest.

  • 14. GOVERNING LAW/DISPUTES – NON-U.S. ENTRANTS

    If your primary jurisdiction of residence is outside the U.S., these Official Rules shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales (provided that such choice of law and jurisdiction will not override the mandatory consumer protections of your jurisdiction of residence, if applicable).


  • 15. GOVERNING LAW/ARBITRATION – U.S. ENTRANTS.

    If your primary jurisdiction of residence is within the U.S., you expressly consent and agree that:


    1. if there is any reason to believe that there has been a breach by you of these Official Rules, Stats Perform may, at its sole discretion, reserve the right to exclude you from participating in the Contest;
    2. Stats Perform reserves the right to hold void, suspend, cancel, or amend the Contest where it becomes necessary to do so and at its sole discretion; and
    3. any claim or controversy arising out of or related to these Official Rules (including the issues of arbitrability of any such claim or controversy) shall be resolved individually, without any resort to any form of class action, and solely and completely by mandatory, final, binding, and non-appealable arbitration, conducted by the American Arbitration Association (AAA), pursuant to the American Arbitration Association Commercial Arbitration Rules and Mediation Procedures (AAA Rules), applying the laws of Illinois. All arbitration shall take place before a single arbitrator selected pursuant to the AAA Rules, at the AAA office located in Chicago, Illinois. The costs of the arbitration including, among other things, any administration fee, the arbitrator's fee, and costs for the use of facilities during the hearings, shall be borne equally by the parties. The arbitrator shall not have any power to alter, amend, modify or change any of the terms of these Official Rules nor to grant any remedy which is either prohibited by the terms of these Official Rules, or not available in a court of law. A judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereover. The parties hereto agree that, notwithstanding the provisions of this paragraph, Stats Perform shall have the right to obtain injunctive or other equitable relief through an action in court. The parties further agree that venue and jurisdiction over any litigation, motion to compel arbitration or to confirm an arbitration award shall lie exclusively with the courts (state or federal) located in and having jurisdiction over Chicago, Illinois, and hereby submit to the jurisdiction thereof.

  • 16. PERSONAL INFORMATION, PUBLICITY AND PRIVACY

    Stats Perform and its authorized agents will collect, use, and disclose the personal information provided by you for the purposes of administering the Contest and prize fulfillment. By entering this Contest, you consent to such collection, use, and disclosure of Entrant's personal information as described herein and in Stats Perform's Privacy Policy at: https://www.statsperform.com/privacy-policy/.


    By accepting the prize described herein, and subject to applicable law, you agree to Stats Perform's use of your name, city/state/province of residence, picture, biographical information, statements, voice and likeness in any advertising and publicity Stats Perform may conduct relating to the Contest in any media or format, whether now known or hereafter developed, including but not limited to the World Wide Web, at any time or times in perpetuity, without further compensation or notice, except where prohibited by law.


  • 17. OUR RIGHT TO VOID / TERMINATE / SUSPEND / MODIFY

    Right to void / terminate / suspend / modify the Contest


    Stats Perform reserves the right to void, suspend, cancel or modify this Contest, in whole or in part, at any time and without notice or obligation if, in Stats Perform's sole but reasonable opinion, any factor interferes with its proper conduct as contemplated by these Official Rules, including but not limited to any interruption, cancellation, or delay as a result of pandemic or any other reason beyond Stats Perform's control.


    Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole but reasonable opinion of Stats Perform, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contests, Stats Perform may, in its sole but reasonable discretion, void any affected entries and: (a) terminate the Contest, or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to address the impairment and then resume the Contest, or relevant portion, in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prize from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner selection criteria discussed above.


    Right to amend these Official Rules


    Stats Perform may amend these Official Rules from time to time if necessary to comply with changes to applicable laws, guidance and/or regulation. If Stats Perform makes any material changes to these Official Rules, it will notify you reasonably in advance and you will be free to withdraw from, or not proceed with, the Contest if you do not agree to the amended Official Rules.


  • 18. SEVERABILITY

    If any provision or any part of a provision of these Official Rules is held invalid, illegal, or unenforceable as a matter of law, that portion, provision or part of the provision, as applicable, shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions, provisions or part of provisions, as applicable, shall remain in full force and effect. If any invalid, unenforceable or illegal provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the provision. To the extent that modification in accordance with the preceding two (2) sentences is impossible, any invalid, unenforceable or illegal provision shall be deemed not to form part of these Official Rules and all other provisions of these Official Rules shall remain in force.
